Common questions
- By when must a rent increase be notified to a tenant in Liechtenstein?
- The landlord can raise the rent to the next possible termination date — for a flat, the end of a month after the three-month notice period or the lease's longer one (§ 1090 Art. 39, 59 para. 1 ABGB). The notice must reach the tenant at least 14 days before that notice period begins. For an increase to the end of June the period begins on 1 April; to leave 14 full days, the letter must reach the tenant by 17 March at the latest. Receipt counts, not posting: post it by registered mail a good ten days earlier, or hand it over against a receipt.
- When is a rent increase void in Liechtenstein?
- When the notice does not state the date on which the increase takes effect or the reasons for it, or when the landlord threatens or gives notice with it (§ 1090 Art. 59 para. 3 ABGB). This letter contains both and mentions no notice; do not send it together with a notice. It is not meant for an indexed (Art. 57) or stepped rent (Art. 58), nor for luxury flats over 150 m² or single-family houses over 200 m² of net living area, to which Art. 55 to 65 do not apply (Art. 3 para. 2).
- What reasons justify a rent increase in Liechtenstein?
- An increase is not allowed if it yields an unreasonable return from the property (§ 1090 Art. 55 para. 2 ABGB). There is no unreasonable return where the rent stays within the local or neighbourhood rents for comparable flats, is justified by cost increases or added services, does not exceed a cost-covering gross return on newer buildings, or preserves purchasing power (Art. 56). Choose the reason and support it with figures. No prescribed form exists.
