For landlords of a flat in Liechtenstein: the written out-of-court notice to the tenant. It contains what § 1090 Art. 47 of the Liechtenstein Civil Code (ABGB) requires — the let property and the date on which the notice takes effect — with three months' notice to the end of a month (Art. 39), and, for a family home, names the tenant's spouse or registered partner, who must be served a second signed copy separately (Art. 49); otherwise the notice is void (Art. 50). Common questions
- What must a landlord's notice in Liechtenstein contain to be valid?
- It must be in writing and signed (§ 1090 Art. 47 para. 1 ABGB; § 886 ABGB) and, unless given through the court, describe the let property and state the date on which it takes effect (Art. 47 para. 2). If the flat is the family home, it must be served separately on the tenant and on the tenant's spouse or registered partner (Art. 49): print the letter twice, sign both copies and send one by its own registered letter to the tenant and one to the spouse or partner, with that person's name on the envelope. If any of this is missing, the notice is void (Art. 50).
- On what notice can a landlord in Liechtenstein end the lease of a flat?
- Three months to the end of a month (§ 1090 Art. 39 ABGB), or the lease's longer period (Art. 37 para. 1). The notice must reach the tenant before the period begins; receipt counts, not posting. So post it by registered mail at least ten days early or hand it over against a dated receipt, and address it to every tenant on the lease. A fixed-term lease ends without notice (Art. 36). Rent arrears have their own procedure with a deadline to pay (Art. 13); this letter is not meant for that.
- What can the tenant do, and what if the tenant stays after a landlord's notice in Liechtenstein?
- The tenant can sue to challenge the notice at the Princely Court of Justice (Landgericht) within four weeks of receiving it, for instance as contrary to good faith (§ 1090 Art. 66, 67 ABGB; § 560 ZPO), and ask for an extension of at most one and a half years (Art. 70; § 566 ZPO); for a family home, so can the spouse (Art. 73). An out-of-court notice is not an eviction order: if the tenant stays, the landlord must sue at the Landgericht and may not change the locks or remove belongings. A landlord who wants the court route from the start can give notice through the Landgericht (§§ 561 to 564 ZPO).
- Does a landlord in Liechtenstein have to give reasons for a notice?
- Not for it to be valid: the minimum content under § 1090 Art. 47 para. 2 ABGB is the let property and the date. But a notice can be challenged if it is contrary to good faith, in particular in the cases of Art. 67, for instance because the tenant asserted rights under the lease. You may give reasons in the letter; if you leave the box empty, the line is left out.
