The notice by which a landlord ends a Romanian residential tenancy. Common questions

Can a Romanian landlord end a fixed-term rental agreement early?
Only if the agreement gives that right, and only to meet the housing needs of the landlord or the family (art. 1825 (2) of the Civil Code). Otherwise a fixed-term agreement ends when its term runs out, or by termination if the tenant breaks it — by not paying the rent, for example.
How much notice must a Romanian landlord give?
At least 60 days for a home with rent paid monthly, counted from the day the tenant receives the notice. If the agreement itself sets a longer period, that applies. The end date written in the notice must fall after the notice period, or the notice can be challenged.
What if the tenant does not leave by the end date?
The landlord cannot take the home back alone — cannot change the locks or remove the tenant's belongings. Eviction is asked of the court, under the special procedure in the Code of Civil Procedure for property used without right. It first requires a written notice to vacate served through a bailiff (art. 1038); for an open-ended agreement the notice ending it also serves as that notice, which is why it is best served through a bailiff too.
