Rental agreements and tenancy documents in Romania

A private landlord in Romania registers a residential lease (contract de închiriere) with the tax authority, ANAF, within 30 days of signing, on form C168, and registers any later change within the same period. It matters beyond tax: a lease signed privately and registered with the tax authority is an enforcement title for the rent under art. 1798 of the Civil Code, so unpaid rent can be enforced without first suing for it. The fixed-term agreement suits a set period, the open-ended agreement a let with no end date, and the room rental agreement a single room in a shared home. To change the rent, both sides sign the rent change addendum.

A tenant may end even a fixed-term lease by written notice of at least 60 days, and a clause allowing less has no effect. A landlord may end an open-ended lease with monthly rent on at least 60 days' notice, but a fixed-term one only if the agreement allows it, and only for the housing needs of the landlord or their family. Each side has its own document: the tenant's notice and the landlord's notice. Subletting a home needs the landlord's written consent, which the request to sublet collects on the same sheet, and the notice of defects asks for repairs and a lower rent.

Until proven otherwise, the law presumes that the tenant received the home fit for use, and at the end the tenant returns it in the condition received, apart from wear due to age. That is why the move-in record and the move-out record are the evidence of what may be kept from the deposit. If the deposit is not returned, the deposit demand gives the landlord 15 days to pay and, sent by bailiff or by registered post with declared contents and acknowledgment of receipt, is the summons required before a court payment order.
