Leases, notice, handover records and deposits in Italy

In Italy a lease of a home must be in writing and is registered with the Agenzia delle Entrate within thirty days on the free RLI form; a landlord who chooses the cedolare secca pays a flat substitute tax and gives up rent increases while the option lasts. The documents are written in Italian under Italian law, and each page describes them in English. The 4+4 lease at a free rent runs four years and renews for four more unless the landlord refuses on a statutory ground; the same rules apply to the lease of a room. The deposit is at most three months' rent and earns legal interest every year, 1.6% from 1 January 2026. Lending a home to a relative free of charge is a comodato, also registered within thirty days.

A tenant may leave early for serious reasons on six months' notice (withdrawal letter). A landlord may refuse renewal only at the first expiry, stating the statutory ground in the letter (refusal to renew); at the second expiry either party may decline renewal without reasons, by registered letter six months ahead (notice at expiry). Rent unpaid for more than twenty days is a ground for termination (demand for unpaid rent), but possession is recovered only through the court.

The handover record and the return record fix the state of the home, on which the return of the deposit depends. A tenant never cuts the rent unilaterally for faults: repairs are demanded in writing (repairs demand), and compulsory mediation comes before any court case. Landlords' and tenants' associations and the Agenzia delle Entrate offer free guides and models. DocMuse's templates are not official documents; this page is up to date as at 13 October 2026.

Owner’s declaration for a guest’s change of residence (Italy)

An Italian sworn self-declaration, in Italian (art. 47 of Presidential Decree 445/2000), by the owner, co-owner, usufructuary or tenant who lets someone register their residence at the home without a contract in that person’s name: it states the basis of occupation (hosting, a loan for use, living together) and the people. The registry office needs it for the title of occupation (art. 5 of decree-law 47/2014). Many municipalities have their own form, attached to the residence declaration, which is free and can also be made online on ANPR. No stamp duty is due (art. 37).
