For a landlord or tenant in Italy who does not want to renew a 4+4 lease at its second expiry, after eight years, or a 3+2 lease at the end of its two-year extension: the waiver of renewal under art. 2 of Italian Law no. 431 of 9 December 1998, which needs no reason, with the end date and a request to arrange the handover. It must be sent by registered letter at least six months before expiry; without it, the lease renews. Not for the first expiry of a 4+4, where the landlord must give a statutory ground. In Italian.

Common questions

When can a 4+4 lease be ended without giving a reason?
At its second expiry, after eight years: either party may then decline renewal, or propose new terms, by a registered letter sent at least six months ahead (art. 2(1) of Italian Law no. 431 of 9 December 1998). For a 3+2 lease the same rule applies at the end of the two-year extension (art. 2(5)). At the first expiry of a 4+4 the landlord may only refuse renewal on a statutory ground, with the dedicated letter.
What happens if neither party sends notice at the second expiry?
The lease renews on the same terms: a 4+4 for another four years, a 3+2 for two years at a time. To prevent it, the registered letter must arrive at least six months before expiry, so it is best posted with time to spare. The renewal, like the ending, is then reported to the Agenzia delle Entrate on the free RLI form by whoever registered the lease.
Does a notice for the final expiry need reasons or both parties' signatures?
No. At the second expiry the waiver of renewal needs no reasons and is the sender's own act: only the sender signs, and it takes effect when it reaches the other party, even if they do not reply or accept it. Where there are several tenants or landlords, the letter is addressed to each. Anyone who wants to propose renewal on new terms instead, such as a new rent, follows the same procedure with a different letter: this one only gives notice not to renew.
