Common questions

How much notice does a tenant in Italy give to leave before the lease ends?
Six months, running from the day the landlord receives the letter; rent remains due until then. Leaving for serious reasons is always possible (art. 3(6) of Italian Law no. 431 of 9 December 1998); without reasons, only if the lease has a withdrawal clause, on the notice it sets. If the landlord agrees to an earlier exit on shorter notice, the agreement should be put in writing and signed by both.
What counts as a serious reason for leaving a lease early in Italy?
The statute does not list them: according to the courts they are facts arising after signing, objective and outside the tenant's control, that make staying too burdensome, such as a job transfer to another city or losing one's job. Simply preferring another home is not enough. The letter describes the facts in the box for serious reasons: for the similar withdrawal from commercial leases the Corte di cassazione requires the notice to state the reason, and a vague letter invites a challenge. If the landlord disputes them, a judge decides after the compulsory mediation.
How is a tenant's notice sent to an Italian landlord?
By registered post with proof of receipt to the landlord's address; by PEC only if the landlord has a PEC address or a digital domicile in INAD; or by hand, with the landlord signing and dating the copy in the receipt box. An uncollected registered letter counts from the day the collection notice is left. Keep the posting receipt and the return card. Free model letters are also available from tenants' and consumers' associations.
