Common questions
- By when must a tenant's notice reach the landlord in Switzerland?
- On the last day before the three-month notice period begins at the latest, or before the longer period in your lease. For notice to the end of March, it must reach the landlord by the end of December. A registered letter counts as received on the first day it can be collected at the post office, usually the day after the collection slip, even if the landlord collects it later — so post it a few days early. A notice that arrives late holds for the next possible date (Art. 266a para. 2 OR).
- Who has to sign the notice on a rented flat in Switzerland?
- Everyone who signed the lease as a tenant. If the flat is the family home, the notice also needs the express consent of the spouse or registered partner, even one who is not on the lease (Art. 266m OR); the letter has a line for it. Without that consent the notice is void (Art. 266o OR). No official form is needed: only the landlord must use the canton-approved one (Art. 266l para. 2 OR). An e-mail is not enough; only a qualified electronic signature with a qualified time stamp equals a handwritten one (Art. 14 para. 2bis OR).
- Which local termination dates apply in a Swiss canton?
- First, the dates in your lease. If it names none, local custom applies, which differs between cantons and sometimes between municipalities; in the canton of Aargau the dates are 31 March, 30 June and 30 September, in Vaud 1 April, 1 July and 1 October, at noon (Art. 35 RULV). For other cantons, choose the neutral line and ask the tenancy conciliation authority for your municipality or look on the canton's website. Where there is no local custom, notice can be given to the end of a three-month rental period (Art. 266c OR). A furnished room has two weeks' notice to the end of a one-month period (Art. 266e OR).
- What if I want to move out of a Swiss flat before the termination date?
- Then the rent remains due until the termination date, unless you propose an acceptable replacement tenant who is solvent and willing to take over the lease on the same terms (Art. 264 OR). A separate letter does that: the early return of the flat with a replacement tenant. You can send the ordinary notice to the next date at the same time, so that the lease ends then at the latest.
