Common questions
- Which replacement tenants can a landlord in Switzerland not reasonably turn down?
- One who can pay and is ready to take over the lease unchanged — the same rent and the same term (Art. 264 para. 1 CO) — with no objective reason against them. The landlord may vet them as any applicant and needs a reasonable time to do it, so send at once what agencies normally want: the application form, a recent extract from the debt enforcement register and proof of income.
- What rent remains due after an early move-out in Switzerland without a suitable successor?
- Rent up to the time the lease ends, or could be ended, under its terms or the law (Art. 264 para. 2 CO), less what the landlord saves in costs and what they earn — or choose not to earn — by letting the flat to someone else (Art. 264 para. 3 CO). Proposing a qualifying replacement frees you from the lease even if the landlord does not take them, from the day they could take over, once the landlord has had reasonable time to check them; the rent runs until then.
- Is it worth sending ordinary notice along with the replacement proposal?
- It is not required, but it is the safer course: if no one takes over the lease, the ordinary notice still ends it on the next termination date, which caps the rent you owe. Post the tenant's notice in the same envelope or separately by registered post, signed by every tenant, and keep copies of both letters and the posting receipts.
