For people renting a flat in Switzerland who want to leave it: the written notice to the landlord or managing agency (Art. 266l para. 1 of the Code of Obligations, CO), giving three months' notice to the date in the lease, or else to a local termination date (Art. 266c CO), and taking effect on the following date if the chosen one is missed. Every tenant signs, and where the flat is the family home so does the spouse or registered partner (Art. 266m CO); the letter also asks for a handover date and the release of the rent deposit. Print it, sign it and post it registered. In Italian.

Common questions

What is the last day a notice on a Swiss flat can arrive?
The day before the three-month notice period starts, or the longer period your lease sets. To leave at the end of March, the landlord must have the notice by the end of December. A registered letter is treated as received on the first day the post office holds it for collection — normally the day after the collection slip — even if the landlord picks it up later, so post it a few days ahead. A late notice is not lost: it takes effect on the following termination date (Art. 266a para. 2 CO).
Whose signatures does a tenant's notice in Switzerland need?
Those of everyone named as a tenant in the lease. Where the flat is the family home, the spouse or registered partner must also give express consent, even if they are not on the lease (Art. 266m CO), and the letter has a line for it; without it the notice is void (Art. 266o CO). No official form is needed: only the landlord must use the canton-approved one (Art. 266l para. 2 CO). An e-mail is not written form; a qualified electronic signature with a qualified time stamp is the only substitute for a handwritten one (Art. 14 para. 2bis CO).
Which local termination dates apply in Ticino and other Swiss cantons?
The dates in your lease come first. If it has none, local custom decides, and it varies between cantons and even municipalities; in Aargau the dates are 31 March, 30 June and 30 September, in Vaud 1 April, 1 July and 1 October, at noon (Art. 35 RULV). For Ticino and the other cantons, pick the neutral line and ask the tenancy conciliation office for your municipality, which also gives legal guidance (Art. 201 para. 2 CPC). Without local custom, notice runs to the end of a three-month rental period (Art. 266c CO); a furnished room needs two weeks to the end of a month (Art. 266e CO).
Can I leave a Swiss flat before my notice period runs out?
You can, but the rent stays due until the termination date unless you put forward a new tenant who is solvent, ready to take over the lease on the same terms and whom the landlord cannot reasonably refuse (Art. 264 CO). A separate letter covers that early return. Sending the ordinary notice at the same time makes sure the lease ends on the next termination date at the latest.
