The notice by which the tenant of a home in Moldova tells the landlord they are leaving: with the three months' statutory notice on an open-ended lease (art. 1281 of the Civil Code), with the notice in the lease, without notice where the home endangers health, or at the end of the term so that it is not tacitly extended. The Civil Code's term for it is rezoluțiune. It sets the hand-back date and asks for the deposit back. Sent by registered post with acknowledgement of receipt.

Common questions

From which day does a Moldovan tenant's three months' notice run?
From the day the notice reaches the landlord: when you hand it over, when it is delivered to the landlord's postal address or, if you e-mail it, when the landlord can access it (art. 22 of the Civil Code). A registered letter with acknowledgement of receipt gives you the date. Count the end date from that day; if you gave less, the lease still ends only after three months (art. 1281(2)).
Can a tenant in Moldova leave without notice if the flat is unsafe?
Yes, if the home is in a state that is a real danger to health — even if you knew of the danger when you signed (art. 1281(3) of the Civil Code). Describe the state of the home in the notice and keep evidence: photos, the handover record, earlier complaints to the landlord. For a defect that only reduces your use of the home, the law instead entitles you to pay less rent (art. 1255).
How should a tenant's notice be sent so that its receipt can be proved?
By Poșta Moldovei, as a registered letter with acknowledgement of receipt, to the landlord's address in the lease; the signed slip is the proof. You can also hand it over and ask the landlord to sign and date your copy. The notice is signed by hand. You can e-mail it if the lease does not require another route (art. 22(2) of the Civil Code), with a qualified electronic signature (MSign or a mobile signature): signed that way, it is a declaration in writing (art. 318(3) of the Civil Code).
