The letter by which a former tenant of a home in Moldova asks the landlord for the deposit back after handing back the home and the keys. It states the amount, the account and a 15-day deadline, disputes unjustified deductions — a tenant does not answer for normal wear (art. 1265 of the Civil Code) — and gives notice of a court order or a claim, with late-payment interest. Sent by registered post with acknowledgement of receipt.

Common questions

What may a Moldovan landlord keep from the deposit when the tenant moves out?
What the lease provides: usually unpaid rent and charges and damage to the home. Normal wear — the ordinary, unavoidable signs of careful use — is not the tenant's to pay for (art. 1265 of the Civil Code). Compare the move-in record with the move-out record: a deduction for a defect already noted at move-in, or not noted at the hand-back, is hard to justify.
What can a tenant in Moldova do if the landlord still keeps the deposit?
You can ask the court for an ordonanță judecătorească, the simplified procedure for the claims listed in art. 345 of the Code of Civil Procedure, among them claims based on a legal act in simple written form such as a lease, or bring a claim at the competent district court. Besides the deposit you can claim late-payment interest (art. 942 of the Civil Code). The general limitation period is three years (art. 391).
Can a Moldovan tenant get a deposit back without a written lease?
A lease of a home must be made in writing (art. 1252 of the Civil Code), and without one the deposit is harder to prove. Use any evidence: the bank transfer, a receipt, messages in which the landlord confirms the amount. You can still send this letter. Without a written lease, check whether the claim falls under another case of art. 345 of the Code of Civil Procedure; if not, an ordinary claim remains.
