Common questions

When must a 4+4 lease be registered in Italy, and what does it cost?
Within thirty days of signing, or of the start date if earlier, with the Agenzia delle Entrate, using the RLI form, which is free online or at an office. Without the cedolare secca, registration tax of 2% of the yearly rent (at least €67) and stamp duty are due; with the cedolare secca, at 21% on a free rent, neither is due. Within the next sixty days the landlord sends proof of registration to the tenant and to the building's administrator.
Can the deposit on an Italian residential lease exceed three months' rent?
No. Article 11 of Italian Law no. 392 of 27 July 1978, still in force for homes, caps it at three months' rent and makes the landlord pay the tenant legal interest at the end of each year; the legal rate is 1.6% from 1 January 2026. A clause excluding the interest is void. The deposit is returned when the lease ends, less only documented damage beyond normal wear.
Can the rent follow the ISTAT index if the landlord chooses the cedolare secca?
No. For as long as the option lasts, the landlord gives up any rent increase, ISTAT indexation included (art. 3(11) of Italian Legislative Decree no. 23 of 14 March 2011), and the statute asks for the waiver to be sent to the tenant by registered letter. The lease offers three choices: cedolare secca with no indexation, no cedolare with indexation at 75% of the ISTAT FOI index on request, or no indexation at all. Landlords' and tenants' associations and the Agenzia delle Entrate publish free models and guides.
