For an owner lending a home in Italy free of charge to a child, a parent or anyone else, and for the person living there: the comodato of articles 1803 ff. of the Italian Civil Code, with the property, residential use, a fixed term or none, ordinary expenses borne by the borrower, and early return if the lender has an urgent, unforeseen need. It is registered with the Agenzia delle Entrate within thirty days on the RAP form (€200 registration tax plus stamp duty); registration is also what the IMU reduction between parents and children requires. Common questions

Does a free loan of a home in Italy have to be registered, and what does it cost?
A written comodato of property is registered with the Agenzia delle Entrate within thirty days of signing, on the RAP form, online or at an office: the fixed registration tax is €200, plus stamp duty, normally €16 for every four pages. The contract has the parties share these costs equally. Registration gives the contract a certain date and is needed for the tax reliefs.
Is there an IMU property-tax reduction when a home is lent to a child in Italy?
Yes, on conditions: art. 1(747)(c) of Italian Law no. 160 of 27 December 2019 halves the IMU tax base for a home lent to a parent or child who lives there as their main home, if the contract is registered, the home is not a luxury category (A/1, A/8, A/9) and the lender lives in the same Comune and owns no other home in Italy besides this one and, possibly, their own main home in that Comune. The Comune's tax office explains free of charge what is needed.
Can the owner ask for the home back before the loan ends?
Under a fixed-term comodato, only if an urgent and unforeseen need arises (art. 1809 of the Italian Civil Code); otherwise at the end of the term. With no term set, the borrower returns the home as soon as the lender asks (art. 1810). The borrower may not lend or let it to anyone else without the lender's consent. Disputes over a comodato must go to mediation before court.
