Common questions
- Who can be given a proxy for an Italian condominium meeting?
- Anyone the owner chooses, including a relative, another owner or a tenant, by a written proxy (art. 67 of the implementing provisions of the Italian Civil Code). The only person excluded by law is the administrator, who may not be given proxies for any meeting. The building's rules cannot depart from this. The proxy may give voting instructions item by item or leave the holder free.
- How many proxies may one person hold at an Italian condominium meeting?
- In buildings with more than twenty owners, a proxy holder may not represent more than one fifth of the owners and more than one fifth of the building's proportional value (art. 67 of the implementing provisions of the Italian Civil Code); in smaller buildings the law sets no limit. Proxies beyond the limit do not count towards the quorum. The owner giving the proxy should therefore check how many the holder already has.
- Must a proxy for an Italian condominium meeting be in writing?
- Yes: art. 67 of the implementing provisions of the Italian Civil Code requires the representative to hold a written proxy. A document signed by the owner naming the meeting and the proxy holder is enough; no certified signature is needed. The holder brings it to the meeting and hands it to the chair at the start. The proxy covers the meeting it names; a new one is signed for another meeting.
