For a landlord in Italy whose tenant is not paying the rent: the formal demand to the tenant listing the unpaid months and the total, recalling that a delay of more than twenty days is a ground for termination (art. 5 of Italian Law no. 392 of 27 July 1978), and requiring payment within fifteen days (arts. 1219 and 1454 of the Italian Civil Code), with the warning that otherwise the lease will be treated as terminated and an eviction for arrears will be brought before the court. By registered post with proof of receipt to the rented home, or by hand. In Italian.

Common questions
- After how long can a tenant in Italy be evicted for unpaid rent?
- Failure to pay rent more than twenty days after it falls due is already a ground for termination (art. 5 of Italian Law no. 392 of 27 July 1978). Eviction for arrears is sought from the court through the intimazione and summons for validation, served by the court bailiff (art. 658 of the Italian Code of Civil Procedure); at the first hearing the tenant can cure by paying, up to three times in four years, and the judge may allow up to ninety days (art. 55 of the same law).
- Can an Italian landlord change the locks on a tenant who does not pay?
- No. Even with rent arrears, the landlord may not take the law into their own hands by changing the locks, cutting off utilities or entering without consent: possession is recovered only through a court order carried out by the court bailiff. The formal demand puts the tenant in default and sets the deadline after which the lease ends, and prepares the eviction proceedings.
- How is the demand sent to a tenant in arrears in Italy?
- By registered post with proof of receipt to the rented home, where the tenant lives, or by hand against a signature; by PEC only if the tenant has a digital domicile in INAD or a PEC address. The fifteen days run from receipt, and an uncollected registered letter counts from the day the collection notice is left. If there is a guarantor, sending a copy is sensible. Keep the posting receipt and return card for court.
