Common questions
- Can a new tenant in Liechtenstein see the previous tenant's return record?
- Yes, if a return record was made when the previous tenancy ended and you ask for it at the handover: the landlord must let you see it in anonymised form (§ 1090 Art. 7 ABGB). It shows what was already noted when your predecessor moved out. Section 1 of this record notes whether you saw it.
- What must a landlord in Liechtenstein do when a flat is handed back?
- Check its condition and report at once any defects the tenant is answerable for; otherwise those claims are lost, except for defects a usual inspection would not have revealed (§ 1090 Art. 52 ABGB). Hidden defects are reported at once on discovery and claimed in court within twelve months after the tenancy ends. Wear from normal use under the lease is not the tenant's to pay (Art. 51 para. 1).
- Should I sign a handover record in Liechtenstein if I disagree with it?
- Note the disagreement under defects found rather than refusing to sign: the signatures confirm the condition recorded, not liability, which the record accepts only where section 6 says so. Take photos at the walk-through. The law requires no record, but it is the best evidence of the condition on moving in and of what the landlord reported in time on moving out. This English version is for your understanding. If it goes to a Liechtenstein authority or court, send the German version: they work in German only.
