For tenants in Liechtenstein with defects in their flat: the written notice of defects to the landlord or the agency. It describes the defects, sets a reasonable deadline to repair them (§ 1090 Art. 20, 21 of the Liechtenstein Civil Code, ABGB), asks for a rent reduction from the time the landlord knew of them (Art. 23) and can warn that future rent will be deposited with the court (Art. 25). Print, sign, enclose photos and send by registered post. This English version is for your understanding. If it goes to a Liechtenstein authority or court, send the German version: they work in German only.

Common questions

Can a tenant in Liechtenstein simply pay less rent while defects are not repaired?
Not safely. The tenant can ask for a reduction in proportion to the impairment, from the time the landlord learned of the defect until it is repaired (§ 1090 Art. 23 ABGB), but should keep paying the full rent until it is agreed: paying less on one's own risks arrears if the reduction is disputed, and the landlord can give notice after a deadline to pay (Art. 13). The alternative the law offers is to deposit the rent with the court after a written deadline, once the deposit is announced in writing (Art. 25).
What happens after rent is deposited with the court in Liechtenstein?
Deposited rent counts as paid (§ 1090 Art. 25 para. 2 ABGB). Within four weeks of the first deposited rent falling due, the tenant must bring the claims — repair, reduction, damages — before the court where the rent is deposited; otherwise the deposited rent goes to the landlord (Art. 26 para. 1). The deposit must be announced to the landlord in writing beforehand, after the deadline in this letter has passed.
Can I try to settle a defects dispute in Liechtenstein before going to court?
Liechtenstein has no conciliation authority for tenancy, unlike Switzerland; the Princely Court of Justice (Landgericht) in Vaduz hears the dispute. Before suing, either side can ask the court to summon the other to a settlement hearing, if the other side lives in Liechtenstein (§ 227 ZPO). The tenancy time limits keep running meanwhile.
