Loans, debts and bank complaints in Moldova
Between private individuals in Moldova, the loan agreement records the sum, the repayment date and any interest. The Civil Code requires written form for acts between individuals worth more than 1,000 lei (art. 321), does not presume interest on a loan between non-professionals, and cuts agreed interest above twice the 12-month CHIBOR rate back to that limit (arts 1242 and 1244). When money is handed over without a contract, the courts accept the loan receipt signed by the borrower as written proof of the loan, and acknowledging the debt interrupts the three-year limitation period (art. 401).
For an overdue debt, the final demand for payment gives the debtor 15 calendar days, claims late-payment interest under art. 942 of the Civil Code and announces an application for a court order (Code of Civil Procedure art. 345) or a claim at the district court. A customer disputing a fee, a payment or a loan term sends the complaint to the bank: under the National Commission for Financial Markets' regulation in force from 1 October 2026, the bank gives a reasoned answer within 15 working days, after which the customer may turn to the Commission (CNPF).
A card payment the holder never authorised is disputed with the unauthorised card transaction dispute within 13 months of the debit at the latest, asking for an immediate refund (Law no. 114/2012, art. 56). The documents themselves are in Romanian, and each page describes its document in English. DocMuse's documents for Moldova follow the law applied by Moldova's constitutional authorities. Those authorities do not exercise effective control in the localities on the left bank of the Dniester or in the municipality of Bender, and no document is meant for the bodies operating there.
