The receipt in which a borrower in Moldova confirms having received a sum of money as a loan from a private individual, acknowledges the debt and undertakes to repay it: both parties with their IDNP, the amount in figures and in words, the date received, the repayment date and, where there is one, the schedule and the interest. The courts accept such a receipt as written proof of the loan. The borrower signs it, and the lender keeps the original.

Common questions
- Is a signed receipt enough to prove a loan in Moldova?
- Yes: the courts accept a receipt signed by the borrower as a written loan contract if it shows the parties, that the money was lent, the amount and the repayment date. That is why the receipt gives both names and IDNPs, the amount in figures and in words, and the deadline. Keep the original: it is your evidence.
- How does acknowledging a debt affect the limitation period in Moldova?
- The general limitation period is three years (art. 391 of the Civil Code). The debtor's acknowledgement of the right, express, as in a receipt, or tacit, such as a part payment, paying interest or asking for more time, interrupts it: a new period starts, and the time that ran before no longer counts (art. 401). The new period starts even if the acknowledgement comes after the old one has run out (art. 401(3)).
- What happens to the receipt once the loan is repaid in full?
- The lender keeps the original until the loan is fully repaid. For each cash payment the borrower asks for a receipt signed by the lender, and with the last instalment can ask for the original back, or for a written statement that the debt has been paid in full.
