What does an acknowledgment of debt do in Romania?
It proves the debt and interrupts limitation: the debtor's acknowledgment wipes out the time already run, and a new period starts after it (arts. 2537 and 2541 of the Civil Code). For the creditor it is one of the safest pieces of evidence; for the debtor, a way to get a payment schedule.
How long before a debt is time-barred in Romania?
The general limitation period is 3 years (art. 2517 of the Civil Code) and usually runs from the due date. Acknowledging the debt interrupts it, and a new 3-year period starts after it.
Does an acknowledgment of debt need a notary?
No. A privately signed acknowledgment is valid and interrupts limitation. Notarised, however, it becomes an enforcement title, so the creditor can go straight to enforcement if the debt is not paid.
