What is a settlement agreement under Romanian law?
The contract by which the parties prevent or end a dispute through mutual concessions (art. 2267 of the Civil Code): each gives up part of what it claims. Once the settlement is carried out, the claims it ended cannot be brought again.
How does a settlement become enforceable?
If a case has started, the parties can ask the court to confirm the settlement in a judgment (art. 438 of the Code of Civil Procedure), which is enforced like any other. If there is no case, a settlement notarised by a notary public is an enforcement title in itself.
What can a settlement not cover?
Rights the parties cannot dispose of — a person's legal capacity or civil status, for example — cannot be settled (art. 2268 of the Civil Code). A settlement is about economic rights: money, property, compensation.
