For two private individuals in Spain with a dispute over money or a contract (a debt, damage, a sale, building work) who settle it without a lawsuit, each giving something up (article 1809 of the Spanish Civil Code). It is a form with fields: the matter, what each side gives or does and by when, the payment and the account, and the waiver of further claims on that matter. It records that the agreement was reached in a negotiation under Organic Law 1/2025 and that either side may have it made into a notarial deed. Not for employment or family matters. Signed in two copies. In Spanish.

Common questions
- What effect does a settlement signed between private individuals have in Spain?
- Between the parties it has the force of a final judgment: the matter is closed and neither may claim on it again (article 1816 of the Spanish Civil Code). Signed only as a private document, it is not directly enforceable: if one side fails to perform, the other has to claim performance. Made into a notarial deed, or approved by the court where that applies, it becomes an enforceable title (Organic Law 1/2025). The signed document also proves that negotiation took place before any claim.
- Can this agreement be used in Spain for a dismissal or a separation?
- No. Employment disputes have their own conciliation before each autonomous community's mediation service, and separations, divorces and arrangements for children have their own procedures. This form is for civil disagreements between private individuals: a debt, damage, a sale, building work or a service. Nor does it end a lawsuit already under way, which has its own route before the court.
- How should the agreement describe what each side gives or does?
- Precisely: what is handed over or done, how much, where and by what date, avoiding vague words such as « as soon as possible » or « as appropriate », which open a new disagreement. If a party pays, give the amount in words and figures and the account it goes to. The form asks for these details, but nobody at DocMuse reviews what you write; if the matter is complex, consult a professional before signing.

Related documents
- Acknowledgement of debt (Spain)
For someone in Spain who owes money to a private person or a company and acknowledges it in writing, or for the lender who wants that paper signed. The debtor, identified by their DNI or NIE, acknowledges the amount in words and figures and where it comes from, and undertakes to pay it in one sum, by bank transfer, by a set date. The acknowledgement interrupts limitation, and the five-year period starts again (articles 1964 and 1973 of the Spanish Civil Code). The debtor signs it and hands the original to the creditor. In Spanish.
- Debt reduction and deferral agreement (Spain)
For a creditor and a debtor in Spain who agree to reduce a debt (quita) and give more time to pay it (espera). It is a form with fields: the original debt in words and figures, the reduction, the amount left to pay, the schedule in one payment or in instalments, the account, and the days of delay allowed before the reduction is lost. Once the agreed sum is paid the debt is extinguished and a receipt in full settlement is given. It records the negotiation under Organic Law 1/2025 and may be made into a notarial deed. Signed in two copies. In Spanish.
- Payment or debt reduction proposal to a creditor (Spain)
For someone in Spain who owes money to a bank, a lender, a utility or a debt collector and wants to offer a smaller lump sum (quita) or instalments (espera) to close the debt. The letter states the amount claimed and the amount offered, the schedule, and makes everything subject to written acceptance stating that, once paid, the debt is settled, with a receipt in full and removal from bad-debtor files. Nothing is paid before that acceptance. Send it by burofax or through the creditor's written channel. In Spanish.
- Complaint to a bank's customer service department (Spain)
For a customer of a bank in Spain with a problem over fees, charges, cards, transfers or any other product who wants to complain in writing. It is the compulsory first step: the customer service department has fifteen working days for payment services and one month otherwise; if it does not reply or rejects the complaint, the next step is a complaint to the Banco de España, on its own form. The letter sets out the facts, states what is requested and invites negotiation (Organic Law 1/2025). Hand it in at the branch against a stamped copy, use the bank's online channel, or send it by burofax. In Spanish.
- Receipt in full settlement of a debt (Spain)
For a creditor in Spain who has been paid a debt (a loan, an acknowledgement, a payment agreement) and for the debtor who needs proof. With the creditor's signature, it states that the amount, in words and figures, was received as full payment or as the last instalment, and that the debt is settled with its interest and costs, with nothing more to claim (articles 1110 and 1156 of the Spanish Civil Code). It can list the documents returned and the undertaking to have bad-debtor file entries removed. The signed receipt is handed to the debtor. In Spanish.
- Demand for payment with an invitation to negotiate (Spain)
For a private person in Spain who is owed money (a loan, a sale, work done) and wants to claim it before going to court. The letter states the amount in words and figures and where it comes from, asks for payment by bank transfer and invites the debtor to negotiate on that same debt, with the thirty days required since 3 April 2025 by Organic Law 1/2025: without that attempt, a claim is not admitted. It also interrupts limitation (article 1973 of the Spanish Civil Code). It is sent by burofax with certified content and proof of delivery. In Spanish.
