A Greek private agreement in which two parties end or prevent a dispute through mutual concessions (art. 871 of the Greek Civil Code): what the dispute is about, what each accepts, who pays whom, how much and by when, and which claims are extinguished. No notary is needed unless it creates or transfers a right in land. With a certain sum, a fixed payment date and both signatures, it is the document a payment order is sought on if the settlement is not honoured.

Common questions

Does an out-of-court settlement in Greece need a notary?
As a rule, no. A settlement under art. 871 of the Greek Civil Code needs no special form, and a private agreement signed by both parties proves it. A notarial deed is needed only when the settlement creates or transfers a right in land — for instance, when one party grants the other a plot or an easement.
What if the other side in Greece does not pay what the settlement says?
Because the agreement sets a certain sum and a fixed date, the party who does not pay is in default as soon as the date passes (art. 341 of the Greek Civil Code) and owes default interest. The signed agreement is a private document proving the claim, and a payment order is sought on it (Code of Civil Procedure, art. 623 ff.) — since 1 May 2026 issued by a lawyer.
Is the Greek digital transaction duty owed on an out-of-court settlement?
A settlement under art. 871 of the Greek Civil Code that provides for a payment of money is among the contracts subject to the digital transaction duty (Law 5177/2025): the duty is reckoned on the sum agreed, and the party who undertakes to pay declares and pays it electronically to the Greek tax authority (AADE). The rate depends on whether the parties act in business, so confirm it with an accountant or AADE before signing. The agreement says which party finally bears the duty.
How is a Greek settlement agreement signed electronically through gov.gr?
With the free “digital certification of a private agreement” service on docs.gov.gr: one party uploads the PDF, up to 5 MB, and names the other by AFM tax number, and each signs with their Taxisnet credentials and a one-time code sent to their mobile. The certification has the same force as a signature authenticated at a citizen service centre (KEP), but it is not a qualified electronic signature.
