Common questions
- How quickly must a Moldovan motor insurer pay compensation?
- The insurer must inspect the damage within 5 working days of receiving the claim, and decide and pay within 30 days of the claim if the claim file is complete, or 90 days if it is not; the decision is sent to you within 5 working days (art. 20 of Law no. 106/2022). For delay it owes a penalty of 0.1% a day, paid with the compensation.
- Who receives the claim after a friendly accident report in Moldova?
- The motor (RCA) insurer of the driver who accepted the blame or, if your own insurer offers direct settlement, your own insurer, with the „Constatare amiabilă de accident” form signed by both drivers (art. 21 of Law no. 106/2022). Your copy goes to the insurer within 2 working days of the accident (art. 18(1)(c) and art. 19(2)). The friendly report is only for two vehicles, with no one injured and no other property damaged; otherwise the police record the accident. Above the ceiling set by the financial-market regulator (CNPF), the insurer pays only up to it.
- What if I disagree with the amount a Moldovan motor insurer offers?
- Lodge your objections with the insurer within 5 days of the claim file being completed; the insurer decides them within 5 working days (art. 29 of Law no. 106/2022). If you still disagree, the insurer pays the amount it set and you may challenge its decision in court (art. 24 and 29). You can also write to the National Commission for Financial Markets (CNPF), which oversees how RCA damage is assessed and compensation paid (art. 1 of Law no. 106/2022).
