- Can accident damage in Austria be claimed directly from the other driver's motor liability insurer?
- Yes. Under § 26 KHVG you have a direct claim against the liability insurer of the vehicle that caused the damage; it is jointly and severally liable with its insured. Which insurer covers a vehicle registered in Austria can be found online through the Austrian Insurance Association (VVO). If the vehicle was uninsured or is never traced, the insurers' association may pay under the Austrian Road Accident Victims Compensation Act (VOEG), for property damage only within limits.
- How long does the other driver's motor liability insurer in Austria have to answer a claim?
- Three months from your notice. If liability and amount are not disputed, the insurer must offer compensation within that time; if it disputes them or has not finished its enquiries, it must give its reasons in writing within the same period (§ 29a KHVG). Your notice also suspends limitation on your claim until the insurer rejects it in writing (§ 27 Abs 2 KHVG). So keep a copy and proof of sending.
- What goes with a claim letter to a motor insurer in Austria?
- Whatever proves how it happened and what was damaged: the European Accident Statement if one was filled in, photos of the scene and the damage, a repair estimate (Kostenvoranschlag), an expert report or the repair invoice, and witnesses' details. Report the damage promptly and in writing, preferably by registered post or the channel the insurer names, and keep copies. Items known only later, such as a hire car, loss of earnings or a drop in value, can follow.
