- Who is the claim made to after a road accident in Romania?
- Directly to the RCA insurer of the vehicle at fault — the injured party does not have to go through the person at fault (Law no. 132/2017). If one's own policy has a direct-settlement clause, the claim can also be opened with one's own insurer, which then recovers the sum from the at-fault insurer.
- What documents go with an RCA claim?
- The document establishing fault — the accident report form signed by both drivers, or the police documents — the ID, the registration certificate and driving licence, photographs, a repair estimate if there is one, and the account details. The insurer gives the exact list when the claim is opened.
- What if the RCA insurer is late in paying?
- Law no. 132/2017 sets deadlines for the offer of compensation and for payment, and late-payment penalties for each day. If the insurer refuses or does not answer, the injured party can turn to the Financial Supervisory Authority, to the SAL-FIN alternative dispute resolution body or to the courts.
