Common questions
- How long is there to report a car accident to a Spanish insurer?
- Seven days from when you learn of it, unless the policy allows more (art. 16 of the Spanish Insurance Contract Act). Reporting late does not lose the cover, but the insurer may claim the loss the delay causes it if it did not learn of the accident otherwise. Reporting by phone, app or website and the European accident statement form are free; this letter also leaves a written record of the report and the claim.
- How long does the other driver's Spanish insurer have to answer?
- Three months from receiving the claim: within that time it must make a reasoned offer of compensation or, if it refuses to pay, give a reasoned reply (art. 7 of the Spanish Motor Liability Insurance Act). If it fails to do so without good reason, it owes late-payment interest. The letter also includes the invitation to negotiate under Spanish Organic Law 1/2025, which gives thirty days to answer before a court claim can be filed.
- What if the Spanish insurer refuses to pay or pays less than claimed?
- You may complain free of charge to the insurer's customer service or customer ombudsman and, if it does not answer or you are not satisfied, to the complaints service of Spain's Directorate-General for Insurance and Pension Funds (DGSFP), whose report does not bind the insurer. A court claim first requires an attempt to negotiate (Spanish Organic Law 1/2025): this letter, sent by burofax and unanswered for thirty days, is the proof of that attempt.
