Common questions
- How long is there to name the driver in Spain, and what if it is not done?
- Twenty calendar days from notification of the request (art. 11.1.a of the Spanish Traffic Act). Not naming the driver, or giving false details, is a very serious offence by the keeper, with no loss of points but a fine of double the original if that was minor and triple if it was serious or very serious, and no 50 % early-payment discount. If the keeper was driving, they can name themselves on the DGT's online office.
- Can the driver be named online in Spain without this document?
- Yes, in most cases: the DGT has a free online service for naming the driver, and many town halls offer one on their own sites; the paper notice often includes a form to send back. This document is for when the body that fined you has no online form, when you prefer your own document with a registry stamp, or to name a driver with a foreign licence. Companies that own the vehicle must file electronically.
- Which details of the driver must be given in Spain?
- Full name, DNI, NIE or passport, address and driving licence number. If the driver is not on the DGT's register of drivers and offenders, for example because they hold a foreign licence, the keeper must hold a copy of the document allowing them to drive in Spain and provide it when asked (art. 11.1.a of the Spanish Traffic Act). The person named then receives the fine notice in their own name and may pay at a discount or object.
