The agreement by which you let another person drive your car — family, friends or acquaintances — including trips abroad: period, purpose, countries allowed, the licence check under § 103 Abs 1 Z 3 of the Austrian Motor Vehicles Act (KFG), insurance and any restricted driver group, costs, fines and damage, handover and return. Until the car comes back, you name the user in reply to a driver enquiry under § 103 Abs 2 KFG. At the end, a separate permission to drive with a short English summary, to carry in the car. Common questions
- Is written permission needed in Austria to drive someone else's car?
- Austrian law requires no paper for it. Abroad, however, police and border controls often ask for proof that the driver may use the vehicle; the permission at the end is meant for that. The registered keeper may let only a person holding the required driving licence drive (§ 103 Abs 1 Z 3 KFG), so the agreement records that the keeper has seen the original licence.
- Must the driver be named in Austria when a lent car was caught speeding?
- Yes. On request the registered keeper must tell the authority, within two weeks, the name and address of the person the car was left to (§ 103 Abs 2 KFG). There is no right to refuse, not even for close relatives; a false, incomplete or late answer is punished. The agreement records the period and the user's name and address so the answer can be given correctly, and provides that the user bears the fines.
- What applies in Austria to a foreign-registered car that is lent to a resident?
- A person whose main residence is in Austria may use a vehicle registered abroad without Austrian registration for only one month after bringing it into Austria (§ 82 Abs 8 KFG); this concerns, for example, a foreign employer's car or a relative's car from abroad. Before the trip, the registered keeper also checks whether the policy limits the drivers or sets a minimum age and, if it does, reports the user to the insurer.
