Common questions
- Does a patient in Moldova have a right to a copy of their medical file?
- Yes. Healthcare providers must give patients unlimited access to their own medical data, test results and the treatment received, and a patient may obtain a copy of any part of their own medical data and records (art. 11(4) of Law no. 263/2005). The original stays with the institution; you receive copies of the pages you ask for.
- Who can ask for a copy of another person's medical records in Moldova?
- For a child under 18 or a person under a judicial protection measure, medical information is given to the legal representative (art. 11(6) of Law no. 263/2005), who attaches the birth certificate or the court decision. For an adult, the patient asks, or a person the patient has authorised by power of attorney. Medical data are confidential towards anyone else (art. 12).
- What can a patient in Moldova do if a hospital refuses copies of their records?
- Ask for the refusal in writing, with its reasons. Then you can complain to the head of the institution and to the Ministry of Health, which answers a petition within 30 days (art. 60 of the Administrative Code); for services under compulsory insurance, also to CNAM, the national health insurer. Law no. 263/2005 also gives you the courts (art. 17).
