Common questions

How long does a Moldovan authority have to answer a public information request?
At most 10 days from registration, and the authority must register the request no later than the next working day after receiving it (arts 15 and 19 of Law no. 148/2023). For a complex request or a large volume of information, the deadline may be extended by at most 7 days, and only if you are told in writing within the 10 days, with reasons.
Must a Moldovan information request give a reason or carry an e-signature?
No. The applicant need not explain or justify the request, and neither a handwritten nor an electronic signature is required (art. 16 of Law no. 148/2023). A request sent by e-mail need not meet the rules for electronic documents (art. 14). It must, however, give your name and postal address — without them it is not examined (art. 17).
How can a refusal or silence on an information request be challenged in Moldova?
By an action in the administrative court, directly, without a prior complaint: within 30 days of the answer or, if the authority did not answer in time, within a year of the deadline passing (art. 25 of Law no. 148/2023). The court decides on the papers within three months (art. 26). You can also complain to the Avocatul Poporului, the ombudsman (art. 31).
Does it cost anything to receive public information in Moldova?
It is free electronically, when you examine the documents on the premises and, on paper, up to 20 pages (art. 22 of Law no. 148/2023). For each extra page the provider may charge 0.02 conventional units, and charges may not exceed the actual cost; you are told the amount first, within the time limit for answering.
