Common questions
- Where does a patient in Moldova complain about a doctor or a hospital?
- First to the head of the medical institution, who must tell you the outcome and the decision taken (art. 16 of Law no. 263/2005). If you disagree, you can go to the Ministry of Health and, for services under compulsory insurance, to CNAM, the national health insurer. The law also provides an independent commission of professional medical expertise and, in any case, the courts (art. 17).
- How long does Moldova's Ministry of Health have to answer a patient's complaint?
- The Ministry of Health is a public authority, and a petition is dealt with within 30 days of registration; this may be extended by at most 15 days, and only if you are told in writing (art. 60 of the Administrative Code). The complaint must give your name, an address for the reply, its subject, the reasons and your signature: an anonymous petition or one without an address is not examined (arts 75–76).
- What should a patient in Moldova attach to a complaint about treatment?
- Copies of what you have: the discharge summary, test results, prescriptions, receipts for paid services, photos, names of witnesses. If you do not have your medical file, ask for a copy first: a patient is entitled to a copy of any part of their own medical records (art. 11(4) of Law no. 263/2005). Keep the originals.
