Request for access to medical records (Romania)

The request by which a patient in Romania obtains copies of their own medical records from a hospital, clinic or practice — the case notes, the discharge letter, test results, imaging — under Law no. 46/2003 and art. 15 of the General Data Protection Regulation. The first copy is free, and the provider answers without delay and within a month, extendable by up to two more months only where the complexity or number of requests makes it necessary.

Is a patient in Romania entitled to a copy of their medical file?

Yes. Law no. 46/2003 on patients' rights gives access to one's own medical data, and the General Data Protection Regulation (art. 15) gives the right to a copy, the first free of charge. The provider answers without delay and within a month; only the complexity or number of requests can justify an extension of up to two months.

Which medical documents can be requested?

The case notes, discharge and referral letters, test results, imaging and medical reports — everything the provider has recorded about the patient. The request lists them, and imaging can be asked for on digital media.

What if the provider refuses access?

A refusal must be reasoned in writing. The patient can complain to the provider's management, to the public health directorate and to the national data protection authority (ANSPDCP) for breach of the right of access.
