Common questions
- Does a loan of money between individuals in Moldova have to be in writing?
- Yes, if it is worth more than 1,000 lei: the Moldovan Civil Code requires written form for legal acts between individuals above that value (art. 321(1)). Without it the loan is not void, but in a dispute it can no longer be proved by witnesses (art. 322). A contract signed by both parties is the clearest form; the courts also accept a receipt signed by the borrower as proof of the loan if it shows the parties, the amount and the repayment date.
- What interest may be charged on a loan between private individuals in Moldova?
- The agreed annual rate may not exceed twice the 12-month CHIBOR reference rate, calculated under the National Bank of Moldova's rules, on the banking day before the rate was set; a higher rate is cut by law to that ceiling (art. 1244 of the Civil Code). With no interest clause, a loan between individuals who are not professionals is free (art. 1242(3)). Late payment carries the interest of art. 942: the National Bank's base rate, or the agreed rate if the loan bore interest, plus 9 points a year, because between individuals who are not professionals neither is a consumer (art. 3).
- How is it proved that a loan was paid out and then repaid?
- A bank transfer is proved by the payment order or the statement, with a reference such as 'loan under the contract of …'. Cash is proved by the receipt slip at the end of the contract, dated and signed by the borrower when the money is handed over. Each repayment is proved the same way: through the bank, or with a receipt signed by the lender.
- What can a lender in Moldova do if the money is not repaid on time?
- Send the borrower a demand for payment by registered post with acknowledgement of receipt. If that does not work, ask the court for a court order (ordonanță judecătorească), which art. 345 of the Code of Civil Procedure also allows for claims based on an act in simple written form, or bring a claim at the district court (judecătorie). The general limitation period is three years (art. 391 of the Civil Code).
