A written agreement for a loan of money between private individuals in Cyprus — relatives, friends, acquaintances: both parties with their identity card or ARC numbers, the sum in figures and words, how and when it is paid out, the repayment schedule, the interest or an agreement that the loan is interest-free, and what happens on late payment. You set the rate, within the limit of article 314A of the Criminal Code. Signed, and with the bank's record of the transfer, it proves the claim in the District Court. Since 2026 it needs no stamp duty.

Common questions

Does a private loan agreement in Cyprus need stamp duty?
No longer. Stamp duty was abolished from 1 January 2026 by Law 239(I)/2025, and a private agreement needs no certification to be valid. What matters is proof: both parties' signatures and the bank's record that the money was paid out.
Is there a maximum interest rate on a private loan in Cyprus?
Yes. Article 314A of the Criminal Code makes it an offence to lend at interest, or for any other benefit, above the reference rate that the Central Bank of Cyprus calculates and publishes every quarter; credit institutions are exempt, private lenders are not. The reference rate changes, so check the current one on the Central Bank's website before agreeing a high rate. Do not write in a rate above the limit: agreeing such interest is itself an offence. The agreement leaves the rate to you and says that anything above the limit is not owed.
What can a lender in Cyprus do if the borrower does not repay?
First send a written demand, by registered post or by hand against a signature, giving a deadline to pay. If the borrower still does not pay, the lender can file a claim in the District Court, usually through a lawyer. The signed agreement and the bank's record that the money was paid out are the main evidence. A contract claim is time-barred after six years (Law 66(I)/2012), so do not let the time run.

It is governed by the Contract Law, Cap. 149, and since 2026 needs no stamp duty.

    A written statement by which a debtor in Cyprus acknowledges owing a creditor a set sum, and what for, and undertakes to repay it on a schedule with a final date. A contract claim is time-barred after six years, and the debtor's written acknowledgement interrupts limitation, which starts running again. No stamp duty is payable.
