Common questions

Is the régie's agreement needed to take in a subtenant in a Swiss colocation?
Yes, the landlord's consent (Art. 262 para. 1 CO). It may be refused only if the terms of the sublease are not disclosed, if they are abusive compared with the main lease, or if the sublease causes major disadvantages (para. 2). The reform that would have tightened these rules was rejected by referendum on 24 November 2024. In the canton of Vaud the tenant asks beforehand for written consent and the landlord answers within thirty days of receipt (art. 21 RULV). A separate letter asks for it.
What notice period applies to a sublet room in Switzerland?
For a furnished room, two weeks to the end of a one-month rental period (Art. 266e CO); for an unfurnished room, three months to a local termination date or, failing one, to the end of a three-month period (Art. 266c CO). The main tenant gives notice in writing on the form approved by the canton, like any landlord of a home (Art. 266l para. 2 CO); without it the notice is void (Art. 266o CO). The subtenant can challenge it within 30 days, but an extension cannot outlast the main lease (Art. 273, 273b CO).
Can a sublease deposit in Switzerland be paid in cash to the main tenant?
No: a cash deposit goes into a bank, on an account or deposit in the subtenant's name, and is at most three months' rent (Art. 257e CO). The sub-rent must stay in a justifiable relation to the rent of the whole flat, for instance by floor space; abusive terms let the landlord refuse consent (Art. 262 para. 2 CO), and subletting on such terms without consent risks, after a written warning, notice ending the main lease (Art. 257f para. 3 CO; BGE 134 III 300). Service charges are owed only if each is listed in the agreement (Art. 257a para. 2 CO).
Must a subtenant in Switzerland leave when the main lease is terminated?
Yes, the right to use the room depends on the main lease: once it has ended, the subtenant returns the room on request, and an extension is possible only for the duration of the main lease (Art. 273b para. 1 CO). The main tenant must therefore give notice of the sublease in time, on the official form. The landlord does not have to take the subtenant on as the new tenant. Where the canton requires the initial-rent form, it applies to the sublease too.
