Common questions

Does a main tenant in Switzerland need consent to sublet a room in a WG?
Yes, the landlord's consent (Art. 262 para. 1 OR). The landlord may refuse it only if the terms of the sublease are not disclosed, if they are abusive compared with the main lease, or if the sublease causes the landlord substantial disadvantages (para. 2). The reform that would have tightened this was rejected by referendum on 24 November 2024. In the canton of Vaud consent must be asked in writing and the landlord answers within thirty days (art. 21 RULV). A separate letter asks for it.
How does a main tenant in Switzerland give notice to a subtenant?
In writing and on the form approved by the canton, like any landlord of a home (Art. 266l para. 2 OR); without that form the notice is void (Art. 266o OR). The period is two weeks to the end of a one-month rental period for a furnished room (Art. 266e OR), otherwise three months to a local termination date (Art. 266c OR). The subtenant can challenge the notice at the conciliation authority within 30 days, but an extension runs only as long as the main lease (Art. 273, 273b OR).
How much may a sub-rent be in Switzerland, and how is a deposit held?
The sub-rent must stand in a justifiable relation to the rent of the whole flat, for instance by the share of floor space and shared areas; abusive terms are a ground for the landlord to refuse consent (Art. 262 para. 2 OR), and a main tenant who sublets on such terms without consent risks, after a written warning, notice ending the main lease (Art. 257f para. 3 OR; BGE 134 III 300). Service charges are owed only as far as they are listed one by one (Art. 257a para. 2 OR). A deposit is at most three months' rent and goes into a bank account in the subtenant's name, not to the main tenant in cash (Art. 257e OR).
What happens to a Swiss sublease when the main lease ends?
It depends on the main lease: once that is ended, the subtenant must give the room back on request, and an extension is possible only as long as the main tenancy is extended (Art. 273b para. 1 OR). The main tenant therefore has to give the subtenant notice in time, on the official form. The landlord has no duty to take the subtenant on as the new tenant. Where the canton requires the initial-rent form, it applies to the sublease too.
