For tenants and landlords in Switzerland on moving into a flat: the record both fill in and sign together at the handover — meter readings, keys, the condition of each room, defects found, work agreed and, on request, the previous tenant's return record and rent (Art. 256a of the Code of Obligations, CO). A second part is for defects found after moving in: the list the tenant signs and has receipted. In the canton of Vaud such defects are reported as soon as the record is received (art. 1 RULV). Print two copies and sign at the walk-through. In French.

Common questions

Can I ask to see the outgoing tenant's état des lieux in Switzerland?
Yes. If a record was made at the end of the previous lease, the landlord must show it to you on request at the handover (Art. 256a para. 1 CO); in the canton of Vaud you receive a copy (art. 1 para. 6 RULV). You can also require to be told the previous rent (Art. 256a para. 2 CO), which helps to spot an abusive initial rent. Section 1 notes both.
How long do I have to report defects missed at the move-in inspection in Switzerland?
The statute sets no period, but many leases do, and the lease's period comes first. In the canton of Vaud the tenant reports defects not noted as soon as the record is received and as quickly as possible; otherwise the record counts as accepted (art. 1 para. 5 RULV). Elsewhere, do it as soon as possible, in writing, with the second part of this document sent by registered post or against a signature, and keep a copy with photos. Without a report, the landlord may claim at move-out that the defect dates from your tenancy.
What if I disagree with what the régie writes in the Swiss état des lieux?
Sign only what matches the real condition, and enter your reservations in section 5 before signing. No statute requires a record at all; it serves both sides as evidence, and your signature confirms the condition found without accepting liability for any defect. Take dated photos. Work the landlord still has to do goes in section 6 with a date; if it is not done, a defects notice with a rent reduction can follow.
