Common questions
- Is a move-in handover record for a rented flat compulsory in Austria?
- No Austrian statute requires one, and it needs no particular form. But it is the proof of the condition in which the flat was handed over: on moving out the flat must be returned in that condition, ordinary wear excepted (§ 1109 ABGB). Both sides sign, each keeps a copy, and dated photos are attached.
- What applies in Austria to defects already visible when moving into a flat?
- If a defect impairs the use of the flat, the rent is reduced by law, and for a dwelling that right cannot be waived in advance (§ 1096 ABGB). But a tenant who takes over a flat with a known defect without any reservation risks having that read as a waiver. So the record lists every known defect and states that rent reduction is reserved; whatever the landlord will still fix is written in with a date.
- Why does an Austrian handover record note the flat's equipment under the MRG?
- Where the Austrian Tenancy Act applies in full, as it does to many flats in older buildings, the maximum permitted basic rent depends partly on the equipment: a bath or shower, a WC inside the flat, heating and the condition at signing decide the flat's category and the additions to and deductions from the reference rent (§§ 15a, 16 MRG). If the tenant later has the rent checked, these are exactly the facts that count.
- Who signs the registration form (Meldezettel) in Austria when a tenant moves into a rented flat?
- The Meldezettel is signed by the accommodation provider, which for a rented flat is usually the landlord or the property manager (§ 8 MeldeG); there is no separate landlord's confirmation besides it. Registration is due within three days of moving in, at the municipal registration office or the Magistrat (§ 3 MeldeG). The form is free from the registration office and on oesterreich.gv.at; with ID Austria, registration can also be done online.

The letter a tenant in Austria sends on leaving a rented flat to claim compensation for improvements — a new bathroom, heating, electricity, gas or water pipes — that remain effective and useful beyond the tenancy (§ 10 of the Austrian Tenancy Act, MRG). The claim must be made in writing with the invoices, within 14 days of the tenant's own notice reaching the landlord, or it is lost. The tenant's letter in Austria reclaiming rent increases charged under an invalid index clause in the lease: the clause, the grounds, the period, the amount, a deadline and the account; further increases are paid only under reservation. Note: the case law is still moving — the Supreme Court (OGH) held clauses invalid in 2023, took a different view in 2025 (10 Ob 15/25s) and ruled again in 2026 (6 Ob 34/26g); for leases signed before 2026 the rent indexation act (MieWeG) limits refunds to five years.
