Employment contracts, leave and workplace disputes in England

In England and Wales every employee and worker must have a written statement of the main terms of the job on or before their first day (sections 1 and 2 of the Employment Rights Act 1996). The contract of employment and the fixed-term contract are written to be that statement as well, with pay, hours, at least 5.6 weeks' paid holiday, notice and where the disciplinary and grievance rules are; Acas publishes free written-statement templates. A later change, such as a hybrid working agreement, is confirmed in writing, and the confidentiality agreement protects business information without restrictive covenants and without stopping whistleblowing.

Unless the contract says otherwise, an annual leave request gives twice as much notice as the leave asked for. Carer's leave is a week a year from the first day of employment (carer's leave notice). Maternity leave is notified by the end of the 15th week before the baby is due (maternity leave notice); paternity leave and unpaid parental leave have been day-one rights since 6 April 2026 (paternity leave notice, parental leave notice). A flexible working request can be made twice in 12 months, and the employer must decide within two months.

When something goes wrong, Acas gives free advice by phone and online, and its Code of Practice expects a written grievance and a chance to appeal a dismissal or warning. Unpaid wages or holiday pay are claimed with a letter before claim, and a statutory redundancy payment must be claimed in writing within six months. Before most employment tribunal claims you notify Acas for early conciliation, free and online; for acts from 1 October 2026 the time limit for most claims is six months less a day, and a grievance does not stop it running.
