Common questions

Who is entitled to parental leave (Elternzeit) in Liechtenstein?
Any employee whose employment has lasted more than six months and who mainly cares for the child — as parent, adoptive or foster parent — has four months, to be taken before the child's third birthday (fifth for adoption or fostering); it cannot be transferred to the other parent (§ 1173a Art. 34c ABGB). Consecutive fixed-term contracts with the same employer count together.
Can my employer in Liechtenstein refuse or delay my family leave?
Maternity leave cannot be refused or delayed. Paternity, parental and care leave may be postponed within a reasonable time if taking it then would seriously disrupt the business; the employer must give written reasons within a reasonable time after your notice and, for parental leave, first offer a flexible arrangement (§ 1173a Art. 34f paras. 2 and 3 ABGB). Dismissal because of the leave is abusive (Art. 46 para. 2 let. f).
Does this letter claim pay or allowances for family leave in Liechtenstein?
No. It gives your employer notice of the leave, which the law asks for three months ahead where possible. Pay or allowances during the leave depend on your contract, the sickness-benefit insurance and the family compensation fund (AHV-IV-FAK), each with its own application; ask your employer which forms they need.
