Common questions

By when must I object to a dismissal in Liechtenstein?
By the end of the notice period at the latest, in writing and received by the employer (§ 1173a Art. 48 para. 1 ABGB). Without a timely objection there is no compensation for abusive dismissal. If you do not agree on continuing the employment, you must sue at the Princely Court of Justice (Landgericht) within 180 days after the employment ends, or the claim lapses (Art. 48 para. 2). When a registered letter counts as received is not settled in Liechtenstein, so send the objection as early as you can or hand it over against a receipt.
When is a dismissal abusive in Liechtenstein?
Among other cases, when it is given because of a personal characteristic, because you exercised a constitutional right, or because you asserted claims in good faith (§ 1173a Art. 46 para. 1 ABGB), and by the employer also because of union membership or because you asked for or took maternity, paternity, parental or care leave (Art. 46 para. 2). The notice stays valid; the court can award compensation of up to six months' pay (Art. 47).
What if I was dismissed in Liechtenstein while ill or pregnant?
After probation the employer may not give notice while you are unable to work through illness or accident without fault — for 30 days in the first year of service, 90 from the second and 180 from the sixth — nor during pregnancy and maternity leave. Such a notice is void; for a notice given earlier, the notice period stops running during that time and resumes afterwards (§ 1173a Art. 49 ABGB). Point this out to the employer in writing, as well as objecting.
