For an employee on an open-ended contract in Greece who has been dismissed and considers the dismissal void or abusive. In this out-of-court notice (εξώδικη δήλωση), served by a court bailiff, the employee contests the dismissal, offers to keep working and takes any severance pay only with a reservation. It is not compulsory and stops no deadline: the lawsuit for nullity must be served on the employer within three months of the end of the employment, and the claim for severance pay within six months of its falling due (art. 351 of the Greek Labour Code, Presidential Decree 62/2025).

Common questions

How long does an employee in Greece have to sue over a dismissal?
The lawsuit for nullity of the dismissal must be filed and served on the employer within three months of the end of the employment relationship; to be safe, count from the day the dismissal reached you. A claim for payment or top-up of severance pay must be served within six months of its falling due (art. 351 of Presidential Decree 62/2025). The three-month period is a strict time bar, and neither the out-of-court notice nor a request to the Labour Inspectorate stops it. The lawsuit is filed through a lawyer.
Is an out-of-court notice needed in Greece before suing over a void dismissal?
No: the law does not require it, and it does not replace the lawsuit. It is useful as dated proof that you did not accept the dismissal, offered your work and take any severance pay only with a reservation. A court bailiff serves it and draws up a report of service. A labour-dispute request to the Labour Inspectorate is free, but it does not replace the lawsuit either.
When is a dismissal void in Greece?
A dismissal is valid only if made in writing, the severance pay due has been paid and the employee was insured (Greek Labour Code, Presidential Decree 62/2025). It is also void where it is due to discrimination or retaliation, is a reaction to the exercise of a legal right or breaches a special provision, such as the protection of pregnancy and maternity (art. 350 of the Code, formerly art. 66 of Law 4808/2021), and where it is abusive (art. 281 of the Greek Civil Code).
What happens to severance pay when a dismissed employee in Greece contests the dismissal?
Receiving severance pay, even without a reservation, does not waive a claim to a higher amount. To make clear that you do not accept the dismissal, the notice says that any sum is taken with an express reservation. If the court finds the dismissal void, it may, at the employee's or the employer's request, award additional compensation instead, from three months' pay up to twice the statutory severance (art. 66 of Law 4808/2021).

  • Out-of-court demand for unpaid wages with withholding of work (Greece)

The out-of-court notice (εξώδικη δήλωση) in which an employee in Greece calls on the employer to pay overdue wages and declares that work is withheld under art. 325 of the Greek Civil Code from a set date: the periods, the amount in words, the IBAN. While a lawful withholding lasts, the employer owes pay as if work continued. A court bailiff serves it, and the bailiff's report of service proves what was said and when — which is what counts at the Labour Inspectorate and in court.

  • Sick leave notice to the employer (Greece)

The written notice in which an employee in Greece tells the employer they are off sick: from when, until when the absence is expected to last, which doctor is issuing the certificate and on what phone number they can be reached. The employer must be told at once, by any means, and the written notice proves when it was done. No paper certificate is enclosed: the doctor issues it electronically through the state e-prescription system run by IDIKA, and only electronic ones count. For the first three days the employer owes half pay (Greek Civil Code arts. 657–658).

  • Request for a certificate of employment (Greece)

The request in which an employee in Greece, when the contract ends, asks the employer for the certificate of employment under art. 678 of the Greek Civil Code, which serves as proof of previous service for a new employer. The certificate states the kind and length of the work, and the quality of the work and the employee's conduct only if the employee asks for that specifically — so the request lets you choose what it should state. One document does the work of both a certificate and a reference.

  • Resignation letter (Greece)

The letter in which an employee in Greece resigns: date of hiring, job, last working day, and a request to settle pay, leave and bonuses and to issue a certificate of employment. Since Law 5239/2025 the resignation that counts is the declaration in ERGANI II within four working days, and the employee may file it personally in myErgani, with no co-signature from the employer. The letter is the dated proof of the decision.

  • Annual leave request (Greece)

The request in which an employee in Greece asks for paid annual leave (Greek Labour Law Code, Presidential Decree 62/2025): the dates, the working days, the year, whether all of the leave or a part of it is asked for, and who covers the work, with room for the employer's answer. From 1 January 2026 leave may be split into more than two parts only at the employee's written request, and this request serves as one; the employer records the leave in ERGANI II afterwards, within the following month.

  • Fixed-term employment contract (Greece)

A Greek employment contract with an end date, carrying the same essential terms as the open-ended one and what sets it apart: the term, the objective reason for the fixed term and the end without notice. The reason matters: successive fixed-term contracts without an objective reason that run past three years in total are presumed to meet permanent needs and become open-ended (Presidential Decree 81/2003). The ERGANI II steps for hiring are included.
