A gift between people close to one another is ordinary enough, but an undocumented gift creates two problems: there is later no proof of whose the thing is, and no proof that it was not a sale. The contract fixes who gives what to whom and from which date. A gift between lineal relatives and between spouses is normally exempt from tax; in every other case the municipality charges local tax, so check before signing.

- Can I get back what I have given?
- Revoking a gift is possible in expressly defined cases, not at will. If you want a condition or an obligation attached, write it into the contract — a promise that someone will look after you is not a clause until it is written down.
- Why do I need a contract if I am simply giving something away?
- Because an undocumented gift gives rise to two disputes: whose the thing is afterwards, and whether it was not in fact a sale. With valuable items that matters both to heirs and to the tax authorities.
- Is a notarial form required?
- For movable property, written form with delivery is usually enough. Certain kinds of property have requirements of their own — with a vehicle, for instance, the procedure for vehicles applies rather than this contract.
