Powers of attorney, parental consents and applications in Poland

Polish law separates a general power of attorney, which covers only acts of ordinary management such as paying bills, collecting post or dealing with offices and must be in writing on pain of nullity (arts. 98 and 99 § 2 of the Civil Code), from one for anything beyond that. The general power of attorney (pełnomocnictwo ogólne) covers the first; selling a car or signing a particular contract needs a special power of attorney naming the type of act or the act itself. Where an act requires a special form, the power of attorney must take that form too, so selling a flat needs one made as a notarial deed. A principal can revoke a power of attorney at any time, unless they waived that right for reasons justified by the underlying legal relationship; the revocation of a power of attorney also demands the document back.

Parents decide important matters for a child together, and where they disagree the guardianship court decides (art. 97 § 2 of the Family and Guardianship Code). A child's passport is issued with the parents' consent or on a court order, and a parent's consent to a child's passport given on paper needs the signature certified by a notary or a passport authority: a voivode's office in Poland or a consul abroad. When a child travels abroad with one parent, grandparents or a camp, a consent for a child to travel abroad records a parent's agreement. Poland has no registered partnerships: the act on the status of a closest person did not survive the presidential veto, which the Sejm failed to override in September 2026. Unmarried couples settle shared costs and property by an ordinary civil contract such as a cohabitation agreement.

Two documents are applications to public bodies. A freedom of information request needs no legal or factual interest to be shown, and the information is due without undue delay and within 14 days; a body that cannot meet that must say why and when within the 14 days, and two months from the request is the limit. An application to change a first name or surname goes to the head of whichever civil registry office the applicant chooses. Freedom of information request (wniosek o udostępnienie informacji publicznej)

A request under Poland's Access to Public Information Act of 6 September 2001, to an office, municipality, school, municipal company or other body performing public tasks: the information sought, the form and way it should be provided, and a reminder of the 14-day deadline and that no legal or factual interest need be shown. No answer in time opens the way to a complaint about inaction to the regional administrative court.

Application to change a first name or surname (Poland)

An application to a Polish civil registry office (urząd stanu cywilnego) for an administrative change of first name or surname, with what the Act on changing names requires: the applicant's details and birth surname, the offices holding the birth and marriage certificates, the new name, any children it extends to, the important reason, and a statement that no application in the same matter was made elsewhere and no refusal was issued. Parental consent to a passport for a child (Poland)

Revocation of a power of attorney (odwołanie pełnomocnictwa)

A principal's statement revoking a Polish power of attorney, saying when it was given and what it covered, demanding the document back (art. 102 of the Civil Code) and listing the people and institutions told of the revocation. Consent for a child to travel abroad (zgoda na wyjazd dziecka za granicę)

A parent's written consent for a minor to travel abroad from Poland — with the other parent, grandparents, a camp or anyone else: the parent's and child's details, the travel document, countries, dates and the adult in charge.
