The written request by which parents — or pupils of full age themselves — ask an Austrian school in advance to let a pupil stay away from lessons, for instance for a wedding or funeral in the family, therapy or a competition. For children of compulsory-school age, leave is granted only as far as strictly necessary: single lessons up to a day by the class teacher (Klassenvorstand), up to a week by the head, longer by the Land's education directorate (§ 9 Abs 6 SchPflG); past compulsory schooling, beyond a day by the head (§ 45 Abs 4 SchUG). Who decides on leave from lessons at a school in Austria?
For children of compulsory-school age, the class teacher (Klassenvorstand) grants single lessons up to a day, the head several days up to a week, and the Land's education directorate anything longer (§ 9 Abs 6 SchPflG). Past compulsory schooling, the class teacher decides up to a day and the head beyond that (§ 45 Abs 4 SchUG). On the form you choose who the request goes to; many schools pass a request for more than a week on to the education directorate.
For what reasons is a pupil in Austria given leave from lessons?
The law gives no complete list. Leave is for foreseeable occasions that cannot be moved outside school time — a wedding or funeral in the family, therapy, a religious holiday or a competition, say — and is granted only as far as strictly necessary. A pupil who stays away without permission, for instance to extend the holidays, is absent without excuse; for a child of compulsory-school age that can be punished as a breach of compulsory schooling (§ 24 SchPflG).
Can a refusal of leave from lessons in Austria be challenged?
For a child of compulsory-school age there is no remedy against the decision of the class teacher or the head (§ 9 Abs 6 SchPflG); ask whether a shorter period would be possible. Longer leave is decided by the education directorate in a formal decision (Bescheid), against which a complaint to the Federal Administrative Court is possible; the deadline is stated in the decision. So apply early — some schools ask for the request several weeks ahead.
