Common questions
- What makes a sports association an ASD recognised for sporting purposes in Italy?
- A statute with the clauses of art. 7 of the Italian Legislative Decree 36/2021, affiliation to a national sports federation, an associated sports discipline or a sports promotion body, and entry in the national register of amateur sports activities, applied for through the affiliating body by filing the statute. Without that entry the club is just an ordinary unrecognised association. The document contains the required clauses and instructs the president to handle affiliation and registration.
- May the directors of an Italian ASD hold office in another sports club?
- Not within the same national sports federation, associated discipline or sports promotion body: art. 11 of the Italian Legislative Decree 36/2021 bars directors from holding office in other amateur sports clubs in the same sphere, and the statute repeats this in article 8. They may hold office in clubs affiliated to other bodies. The statute also provides for elected offices and a general meeting in which every adult member has one vote.
- What does it cost to register an ASD's founding deed in Italy, and is a notary needed?
- No notary is needed: an unrecognised ASD is founded by a private deed signed by the founders. The deed and statute are registered at an office of the Agenzia delle Entrate with the fixed registration tax of €200 (form 69 and payment by F24), and the tax code is requested with form AA5/6. A public deed is needed only to obtain legal personality. Affiliation and registration fees are those set by the affiliating body.
