The written request a club, nursery, school, youth-welfare provider or other organisation in Germany gives an employee or volunteer so that they can apply for an extended certificate of good conduct (erweitertes Führungszeugnis): under § 30a(2) of the Federal Central Criminal Register Act (BZRG), it is issued only to someone who presents such a request, in which the organisation confirms that the conditions of § 30a(1) are met. - Why does an extended certificate of good conduct in Germany need a written request?
- Because the law says so: under § 30a(2) of the Federal Central Criminal Register Act (BZRG), anyone applying for an extended certificate must present a written request in which the body requiring it confirms that the conditions of § 30a(1) BZRG are met. Without that request the extended certificate is not issued.
- For which activities may a German organisation require an extended certificate of good conduct?
- Under § 30a(1) BZRG: for checking personal suitability under § 72a of Book VIII of the Social Code (SGB VIII), as youth-welfare providers do; for any other professional or voluntary supervision, care, education or training of minors; for an activity that gives contact with minors in a comparable way; and where another statute provides for it with reference to that section. - Where is the extended certificate applied for in Germany, and what does it cost?
- At the registration office, or online through the Federal Office of Justice's portal using the online ID function of the identity card or electronic residence permit. The fee is €13. For voluntary work the Federal Office of Justice can waive the fee; this request, which confirms the voluntary activity, goes with the application for the waiver.
- Who signs the request on behalf of a German organisation?
- Someone entitled to represent the organisation or designated by it — in a club usually a board member, in an institution its management or HR department. The law requires a written request, so sign it by hand and give the person the original. For an online application the person submits it in the way the Federal Office of Justice's portal asks.
