For anyone who must declare to a town hall, an autonomous community or a State body that they meet the requirements of a procedure and hold the supporting documents. Many Spanish administrations publish their own model, free in their electronic office: if one exists, use it. This model follows article 69 of Spain’s Common Administrative Procedure Act (Ley 39/2015). It is filed online, at a registry office or at a Correos post office; companies must file electronically. Before a body with a co-official language, that language may also be used. In Spanish.

Common questions

Where is a responsible declaration filed in Spain?
With the body that asks for it: in its electronic office, at any public registry office or at Correos as administrative mail, in an open envelope so the copy is stamped (article 16.4 of Ley 39/2015). Companies, registered professionals and their representatives must file electronically (article 14.2). Before a town hall or community with a co-official language, you may also use that language.
What effect does a responsible declaration have in Spain?
It lets you obtain or exercise the right, or start the activity, from the day it is filed, while the body may later check the requirements and ask for the documents (article 69.3 of Ley 39/2015). If an essential fact is inaccurate, false or omitted, the right or activity cannot continue from when the body learns of it, besides any liability that applies.
Does a responsible declaration work with a Spanish bank, landlord or company?
Not as of right: the responsible declaration belongs to administrative procedure, and an individual or a company need not accept it instead of a certificate. To prove to them a fact held in a public register, ask the issuing body for the certificate, often available in its electronic office.
